1. Scope of License Licensor grants you a non-transferable license to use the Bloomistry app (“Licensed Application”) on your personal devices that support the app, subject to the terms of this Agreement. You may not distribute, sublicense, or use the app on any platform not authorized by Licensor. If you sell or transfer your device, you must remove the app from the device before doing so.
2. Data Collection This app does not collect, store, or share any personal data from users. It does not require sign-in or account creation. The app may collect technical data such as device type and app usage for the purpose of improving the app, but this data is non-personal and is not linked to you.
3. Termination This Agreement is effective until terminated by you or Licensor. Your rights under this Agreement will terminate automatically if you fail to comply with any terms of this Agreement.
4. No Warranty The app is provided “as-is” without warranty of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including the warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the accuracy of AI-generated designs or app functionality. If the app malfunctions or does not meet expectations, your sole remedy is to cease using the app.
5. Limitation of Liability In no event shall the Licensor be liable for any indirect, incidental, or consequential damages, including but not limited to loss of data or profits, arising out of your use or inability to use the app, even if advised of such possibility. The maximum liability shall be limited to $50.00.
6. Export Control You may not export the app to countries under U.S. embargo or to individuals on the U.S. Department of Treasury’s Specially Designated Nationals list. You are responsible for complying with all local laws when using the app.
7. Governing Law This Agreement shall be governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes or claims arising from this Agreement shall be resolved in the appropriate courts located in Long Beach, California, which will have exclusive jurisdiction over such matters.
