1. Scope of License

Licensor grants you a limited, non-exclusive, non-transferable, revocable license to use the Bloomistry application (“Licensed Application”) on any Apple-branded devices that you own or control, and as permitted by the Usage Rules set fort in the Apple Media Services Terms and Conditions. This license is for your personal, non-commercial use only. You may not distribute, sublicense, rent, lease, lend, sell, copy, modify or otherwise make the Licensed Application to any third party. You may not use the Licensed Application on any device that you do not own or control. If you sell or transfer a device, you must remove the Licensed Application prior to doing so.

2. Data Collection and Privacy

The Licensed Application does not require user accounts or sign-in and does not collect, store, or share personally identifiable information. The app may collect limited anonymous technical information such as device type or app usage data, solely for the purpose of improving app performance and functionality. This data is non-personal, is not linked to you, and is handled in accordance with app’s privacy policy.

3. Termination

This Agreement is effective until terminated by you or Licensor. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any terms of this Agreement. Upon termination you must cease all use of the Licensed Application and delete all copies in your possession.

4. No Warranty

You expressly acknowledge and agree that use of the Licensed Application is at your sole risk. To the maximum extent permitted by applicable law, the Licensed Application is provided “AS IS” and AS Available,” without warranty of any kind. Licensor disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Licensor does not guarantee the accuracy or reliability of AI-generated designs or uninterrupted app functionality. If the app malfunctions or does not meet your expectations, your sole remedy is to cease using the app.

5. Limitation of Liability

To the maximum extent permitted by applicable law in no event shall Licensor be liable for any indirect, incidental, special consequential or punitive damages including but not limited to loss of data or profits, arising out of your use or inability to use the Licensed Application, even if Licensor has been advised of the possibility of such damages. Licensor’s total liability to you for any claims arising under this Agreement shall not exceed the amount you paid, if any, for the Licensed Application. This Agreement does not limit any liability that cannot be limited or excluded under applicable law, including liability relating to personal injury, fraud, or gross negligence.

6. Export Control

You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties, including the U.S. Department of Treasury’s Specially Designated Nationals List. You agree to comply with all applicable U.S. and international export laws and regulations in your use of the Licensed Application.

7. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. Any disputes arising out of or relating to Agreement shall be resolved in the state or federal courts located within California, unless otherwise required by applicable consumer protection laws.
